Georgia Yeh Photography Contract

Deposit and Payment. Upon signing the contract, the Client is responsible to make a non-refundable full payment to retain Georgia Yeh Photography to perform the services specified herein. It is the Client’s guarantee that Georgia Yeh Photography will not cancel the booking to book another client. Client will receive store credit (with no expiration date) if Picture Day is cancelled, changed to a new date, or Georgia Yeh Photography is unavailable to provide services. Extra charges set forth on or after the date of session shall be billed if and when incurred.

Copyright. Georgia Yeh Photography shall own the copyright in all images created and shall have the exclusive right to make reproduction for portfolio, samples, self-promotions, entry in photographic contests or art exhibition, editorial use, or for display within or on the outside of her studio.

Client’s Usage. Client is obtaining digital electronic images for personal use only and shall not sell or authorize any reproductions for profit thereof by parties other than Georgia Yeh Photography.

Liability. Georgia Yeh Photography’s liability is limited to refund of monies paid. It is the responsibility of the Client to provide all necessary event details, time, and location information. Georgia Yeh Photography is not liable for any time lost due to the Client's tardiness. Georgia Yeh Photography takes the utmost care in producing the client’s images. In the unlikely event that a problem arises and she is unable to provide any images, all monies paid will be refunded. Client is not guaranteed any particular shot during the session. In the very unlikely event that an emergency arises or unforeseen circumstances and Georgia Yeh Photography is unable to perform the services, the client will be notified immediately and all monies paid will be refunded to the client. If this were to occur, every effort possible will be made by Georgia Yeh Photography to recommend and secure another competent photographer for the client. The limitation on liability shall also apply in the event that the photographic materials are damaged in processing, lost through camera malfunction, lost in mail, or otherwise lost or damaged without fault on the part of Georgia Yeh Photography. In the event Georgia Yeh Photography fails to perform for any other reason, Georgia Yeh Photography is not liable for any amount in excess of the amount paid by the Client.

COVID - 19 ADDENDUM

Onyx Cinema, Inc., Georgia Yeh Photography and/or its partners operate in accordance with health and safety guidelines, including those set forth by the CDC in regards to infectious diseases, including but not limited to COVID – 19. However, as the virus is ongoing and there is no guarantee against infection, the client acknowledges and agrees to the following:

With full knowledge of the risks involved, the client hereby releases, waives, discharges Onyx Cinema, Inc., Georgia Yeh Photography and/or its partners from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained related to COVID-19 while shipping/receiving product or correspondence, participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

Furthermore, the client agrees to indemnify, defend, and hold harmless Onyx Cinema, Inc., Georgia Yeh Photography and/or its partners from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.

This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted.
